Investor-State Dispute Settlement: A Reality Check
Today, the legitimacy of treaty-based investment protection is being challenged. Investment agreements and investor-state dispute settlement (ISDS) are being challenged from a broad range of disparate groups. Further, governments which once led the development of investment protection now seem to worry more about their own "defensive" interests.
